Kyiv regional state administration

According to the Constitution of Ukraine and the Law of Ukraine "On Local State Administrations" the Regional State Administration is a body of executive power and within the limits of its authorities accomplishes executive power on the territory of the region, as well as implementing powers delegated to it by the Region Council.

The Regional State Administration within state determined of the legislation of authorities protects the right and legal interests of citizens and state, provides integrated social and economic development of region's territory and realization of state policy in areas of governance determined by legislation.

In its activity it's administered by the Constitution of Ukraine, the Laws of Ukraine, the decrees of the President of Ukraine, orders of the Cabinet of Ministers of Ukraine, by other normative acts of legislation.

The Regional State Administration acts on the basis of legality, publicity, combination of all state and local interests, responsibility before individual and state for its activity. It provides interaction with the bodies of local government.

The Regional State Administration is chaired by the Head, who is appointed by the President of Ukraine. In case of absence of the Head of the Regional State Administration his functions accomplishes first Deputy Head of the Regional State Administration and in case of absence the last one - one of Deputies of the Head.

The main objectives of the Regional State Administration

Kyiv Regional State Administration within corresponding administrative and territorial unit ensures:

1) ) implementation of the Constitution of Ukraine, the laws of Ukraine, the acts of the President of Ukraine, the Cabinet of Ministers of Ukraine, other bodies of the executive power of top level;

2) legality, law and order, the observance of rights and freedoms of citizens;

3) implementation of state and regional programs of social, economic and cultural development, the programs of environment protection, and in the places of the compact habitation of fundamental nations and national minorities and also programs of their national and cultural development;

4) preparation and implementation of respective budgets;

5) report on implementation of respective budgets and programs ;

6) interact with the bodies of local government;

7) realization another authorities conferred by state, and also delegated by corresponding councils.

Kyiv Regional State Administration and its structural branches work on basis :

- Responsibility before individual and state for its activity; 
- Right supremacy; 
- Legality;
- Priority of human rights;
- Publicity; 
- Combination of state and local interests.

Activity order of Kyiv Regional State Administration is defined:

By the Constitution of Ukraine, by the Law of Ukraine "On Local State Administrations", by other Laws of Ukraine, the acts of the President of Ukraine and the Cabinet of Ministers of Ukraine, by typical regulations of local state administrations which are affirmed by the order of the Cabinet of Ministers of Ukraine from 31.10.2007 № 1270, by the Regulations of Kyiv Regional State Administration which are affirmed by the order of Head of Kyiv Regional State Administration from 27.11.2007 № 1305 (with variations from 27.07.2009 № 645), by the regulations about the management staff of Kyiv Regional State Administration (the order of Head of the Regional State Administration from 07. 06.2006 № 445, with variations from 11.07.2007 № 553), by the record keeping instruction in the management staff, main departments, departments and another structural subdivisions of Kyiv Regional State Administration (order of Head of Kyiv Regional State Administration from 19.06.2008 № 900).

The order of the appeal against decisions, adopted by Kyiv Regional State Administration

According to paragraph 4 article 38 of the Law of Ukraine "On Local State Administrations", "the decisions of the officials of local state administrations can be appealed to the President of Ukraine, to the body of the executive power of top level, to the Commissioner of the Verkhovna Rada of Ukraine on Human Rights or to the court".

According to the first part of article 43 of the Law of Ukraine "On Local State Administrations" "the acts of Local State Administrations, which are contradicted to the Constitution of Ukraine, the laws of Ukraine, the decisions of the Constitutional court of Ukraine, the acts of the President of Ukraine and the Cabinet of Ministers of Ukraine or to the interests of territorial communities or separate citizens, can be appealed to the body of the executive power of top level or to the court".

In accordance with article 50 of the law of Ukraine "On Local State Administrations"- "orders of the heads of local state administrations, the acts of other officials, which are adopted by them, can be appealed in judicial order according to the law"
